    1. Introduction and Acceptance

    Welcome to Pikando. These Terms of Service (“Terms”) are a legally binding agreement between you and Pikando Digital Private Limited (“Pikando”, “we”, “us”, or “our”), a company incorporated under the Companies Act, 2013, with its registered office at #17, 2nd Floor, 7th Main Road, II Stage, Indiranagar, Bengaluru - 560038, Karnataka, India.

    Pikando operates a task marketplace platform (“Platform”) connecting individuals who need tasks completed (“Posters”) with verified service providers who perform those tasks (“Seekers”). These Terms apply to all users of the Platform, whether you use Pikando as a Poster, a Seeker, or both.

    By creating an account, accessing, or using the Platform, you agree to be bound by these Terms together with our Privacy Policy and Community Guidelines (available at https://pikando.com/legal, collectively “Pikando Policies”). If you do not agree, you must not use the Platform.

    Pikando is not a party to any agreement between Posters and Seekers. Pikando acts as an intermediary under the Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, facilitating connections, communications, identity verification, and payment processing. Seekers are independent service providers, not employees or agents of Pikando.

    Your use of third-party services facilitated through the Platform (such as identity verification and background checks) is subject to those providers’ own terms, which are presented to you during those processes.

    We may update these Terms from time to time. Material changes will be notified via the app or SMS at least 15 days before taking effect. Continued use after that date means you accept the revised Terms.

    2. Definitions

    • Poster: A registered user who creates and posts tasks on Pikando seeking services.
    • Seeker: A registered user who offers services and accepts tasks posted by Posters. Seekers undergo mandatory identity verification.
    • Task: A service, project, or assignment posted on Pikando by a Poster to be completed by a Seeker.
    • Platform: The Pikando mobile application (iOS and Android), including in-app chat, in-app voice calling, payment system, SOS feature, and all related services.
    • Agreed Price: The task price mutually agreed between Poster and Seeker through the Platform.
    • Commission: The platform fee Pikando charges Posters for facilitating the transaction, currently 8% of the task value (see Section 8).
    • Milestones: Optional task sub-divisions defined by the Poster at the time of posting. Milestones serve as reference points for calculating proportional payments in the event of a dispute or partial completion.
    • Grievance Officer: Pikando’s designated officer for addressing user complaints as required under Indian law.
    • Pikando Policies: These Terms, the Privacy Policy, and the Community Guidelines, all of which are incorporated by reference.

    3. Eligibility and Account Registration

    3.1 Eligibility

    To use Pikando, you must be at least 18 years old and legally capable of entering into binding contracts under the Indian Contract Act, 1872. By creating an account, you represent that all information you provide is truthful, accurate, and current, that you have not been previously suspended or removed from Pikando, and that you will comply with all applicable laws.

    3.2 One Account Per User

    Each individual may create only one account on Pikando. You initially register as either a Poster or a Seeker, and may upgrade your account to include the other role at a later stage. You must not create multiple accounts, create accounts for others, or impersonate any person.

    3.3 Account Security

    You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@pikando.com if you suspect unauthorized access.

    3.4 Communications

    By registering, you consent to receive electronic communications from Pikando (in-app notifications, SMS, WhatsApp) regarding your account, tasks, transactions, and policy updates.

    4. Identity Verification and Safety

    4.1 Mandatory KYC for Seekers

    All Seekers must complete identity verification before they can bid on tasks or receive payouts. Verification is conducted through our verification partner and may include verification using Aadhaar, PAN, DigiLocker records, facial verification, liveness checks, or other government-issued identity documents and verification methods as determined by Pikando or its verification partners.

    By proceeding with verification, you consent to the verification methods selected for your account. Only your verification status, a tokenized reference, and demographic details are retained. Raw identity document data (such as Aadhaar numbers) is not stored by Pikando. Verification is conducted through authorised third-party providers who process your data in accordance with their own terms and applicable regulations.

    The photograph captured during liveness verification is stored securely as your verification reference image and is used for identity confirmation during subsequent task assignments. With your separate, explicit consent, the same photograph may also be set as your initial profile picture on the Platform. Your verification reference image and your profile picture are distinct images, each governed by its own consent.

    4.2 Location-Based Face Verification

    For in-person tasks, Seekers complete a face match verification when arriving at the task location. This confirms the arriving Seeker is the same verified individual. The arrival verification image is compared against your verification reference image (the live photograph captured during identity verification) and is deleted immediately after verification.

    4.3 Background Verification

    Depending on the task category, Seekers may be required to complete additional background verification. Pikando uses a tiered verification framework:

    • Tier 1: Court Record Verification (CCRV) + Police Clearance Certificate (PCC) (Childcare, elderly care, and similar high-trust categories)
    • Tier 2: PCC only (Drivers and similar categories)
    • Tier 3: CCRV only (Locksmiths, movers, tutors working with minors, and similar categories)
    • Tier 4: KYC only (mandatory identity verification) (All categories: KYC is the mandatory baseline for every Seeker; Tiers 1-3 add background verification on top for the categories listed above)

    Seekers who complete background verification will display verification badges on their profiles: a PCC badge for police clearance and a CCRV badge for court record clearance.

    IMPORTANT: VERIFICATION LIMITATIONS

    Pikando does not conduct comprehensive background verification. All verification and background checks performed on the Platform are limited, point-in-time checks conducted through third-party providers. They are not guarantees of identity, conduct, criminal history completeness, suitability, competence, or future behaviour. Background checks reflect only the records available at the time of the check and may not capture all relevant information. Pikando does not independently verify the accuracy or completeness of third-party verification results. Records may be incomplete, delayed, or unavailable in certain jurisdictions.

    Users remain solely responsible for exercising independent judgment before engaging with another user for any task. Pikando strongly recommends that Posters conduct their own due diligence, meet Seekers in safe public spaces where feasible, and take reasonable precautions during in-person interactions.

    Verification status reflects only the status at the time of verification and may not remain current thereafter. Pikando does not monitor for subsequent changes in a Seeker’s criminal record, licence validity, or personal circumstances after the initial verification is completed.

    4.4 Professional Certification Requirements

    Certain task categories require valid professional certifications or licences before a Seeker can bid. These include, but are not limited to, electrical work (Wireman Licence), plumbing (ITI Plumber Certificate), pest control (PCO Licence), legal services (Bar Council enrolment), food preparation and catering (FSSAI Registration or Licence), driving (valid driving licence of the applicable class), and gas fitting (competency certificate). The full list of certification requirements is maintained within the Platform and is visible to Seekers during onboarding. Seekers without the required certification cannot bid on tasks in gated categories.

    4.5 Verification for Posters

    Posters complete standard account verification via mobile number (OTP). Enhanced identity verification may be introduced in the future.

    5. Posting and Accepting Tasks

    5.1 For Posters: Creating a Task

    When posting a task, you agree to provide a clear and accurate description of the work, the location (for in-person tasks), and a fair budget or price. A deadline may optionally be specified. You are solely responsible for the accuracy of your task postings. Misleading, false, or fraudulent listings will be removed and may result in account suspension.

    5.2 Prohibited Tasks

    You must not post tasks that violate Indian law or Pikando’s Community Guidelines, including tasks that involve illegal activities, adult services, unlicensed professional work, discrimination, endangerment of any person, child labour, or circumvention of platform protections. A full list of prohibited categories is in our Community Guidelines.

    5.3 Local Compliance

    Users are responsible for ensuring that tasks comply with all applicable local laws, housing society rules, resident welfare association (RWA) requirements, landlord restrictions, municipal regulations, and permit requirements. This includes but is not limited to noise restrictions, event permissions, parking rules, and trade licences where applicable.

    5.4 Pikando’s Right to Remove Listings

    Pikando may remove, restrict, edit, or refuse any task, listing, profile, or content at its sole discretion where required for legal, safety, operational, or policy reasons, without prior notice. This includes tasks flagged by automated moderation, reported by users, identified through internal review, or subject to law enforcement requests.

    5.5 For Seekers: Bidding

    Seekers may submit offers for tasks they are qualified and willing to perform. Your offer must be made through the Platform. By submitting an offer, you confirm you are available and competent to complete the task as described. For categories requiring professional certification, you must hold the required credentials before bidding.

    5.6 Task Assignment and Payment

    When a Poster selects a Seeker’s offer, payment is collected from the Poster and held securely by our licensed payment partner until release conditions are met. Once payment is confirmed, the task moves to the active stage and both parties are expected to communicate via Pikando’s in-app communication channels (chat and voice calls). In-app voice calls are available only between the matched Poster and Seeker while a task is active, and are not recorded. Any changes to task scope, price, or terms agreed on a call must be confirmed in the in-app chat to be considered in dispute resolution.

    5.7 Milestones

    Posters may optionally define milestones when creating a task. Milestones break the task into sub-stages with descriptions and proportional value. They serve as reference points for dispute resolution. If a dispute arises mid-task, the resolution team uses milestone completion status to determine proportional payment splits. Milestones do not trigger individual payment releases; the full Agreed Price is held securely until task completion or dispute resolution.

    6. Task Performance and Completion

    6.1 Seeker Obligations

    Once assigned a task, Seekers agree to perform with diligence and professionalism, be punctual and communicate proactively about delays, use only Pikando’s in-app communication channels (chat and voice calls) for task communications, comply with all applicable laws and regulations, complete face verification upon arrival at task locations, maintain confidentiality of any private information accessed during tasks, and carry their own basic tools unless otherwise agreed.

    Tasks must be performed personally by the verified Seeker who accepted the task. Substitution, subcontracting, or bringing helpers or assistants to a task is not permitted. The individual who completed identity and background verification must be the individual who performs the task. Sending an unverified substitute defeats Pikando’s verification safeguards and will result in immediate account suspension or termination.

    6.2 Poster Obligations

    Posters must provide a reasonably safe, clean, and appropriate environment for Seekers performing in-person tasks. Posters must disclose in advance any known hazards, pets, dangerous conditions, health or safety risks, restricted access areas, or other circumstances materially relevant to the task. Failure to disclose material risks may result in the Poster bearing liability for any resulting harm and forfeiture of dispute rights.

    Posters are responsible for ensuring reasonable and lawful access to the task location, including any required permissions, entry approvals from gated communities or housing societies, utilities, parking, and safety disclosures necessary for task performance. Pikando and Seekers shall not be responsible for delays or inability to perform tasks caused by access restrictions, gated community policies, missing permissions, unsafe conditions, or undisclosed hazards.

    Users are responsible for securing valuables, confidential documents, fragile items, pets, and sensitive equipment before task commencement. Pikando shall not be liable for loss or damage to unsecured items during task performance.

    6.3 Seeker’s Right to Refuse Unsafe Work

    Seekers may refuse to commence, or discontinue, any task where safety risks, illegal activity, harassment, intoxication, hazardous conditions, or material misrepresentation by the Poster are present. A Seeker who refuses or discontinues work under such circumstances will not be penalised and may be entitled to partial or full compensation at Pikando’s discretion based on evidence provided.

    6.4 Professional Licences

    If a task requires specific professional licences or permits (electrical work, plumbing, driving, food handling, etc.), the Seeker must hold valid credentials. Pikando verifies credentials during onboarding and may re-verify with issuing authorities.

    6.5 Task Completion Flow

    • Seeker marks the task as complete in the app
    • Poster receives a notification to review and confirm
    • Poster has 48 hours to confirm completion or raise a dispute
    • If the Poster confirms, payment is released to the Seeker
    • If the Poster does not respond and does not raise a dispute within 48 hours, payment is automatically released to the Seeker
    • If a dispute is raised, funds remain held until resolution

    6.6 Safety

    Pikando provides an SOS emergency feature accessible from within the app during active tasks. Both Posters and Seekers should keep this feature accessible. If you feel unsafe at any point, stop work, remove yourself from the situation, and contact local emergency services (police: 100/112) immediately.

    The SOS feature is an assistive tool only. It may not function in all situations, including but not limited to areas with limited network connectivity, device malfunctions, or service outages. Pikando does not provide real-time monitoring, guaranteed emergency response, or emergency dispatch services. Users must not rely on the SOS feature as a substitute for contacting police or emergency services directly. Pikando shall not be liable for any failure, delay, or limitation of the SOS feature.

    7. User Conduct

    All users agree to treat others with respect and professionalism. The following are strictly prohibited:

    • Harassment, abuse, threats, discrimination, or any conduct violating the dignity or safety of others
    • Off-platform payments: all payments for tasks must go through Pikando’s payment system
    • Contacting users outside the Platform to circumvent Pikando’s safety features or payment system
    • Providing false information, fake reviews, or manipulating ratings
    • Posting prohibited content as defined in the Community Guidelines
    • Attempting to hack, introduce malware, or compromise Platform security

    Pikando has zero tolerance for harassment, sexual misconduct, or threats of violence. Violations result in immediate account termination and may be reported to law enforcement under the Bharatiya Nyaya Sanhita, 2023 and other applicable laws.

    Discrimination protections apply to both sides of the marketplace: Posters must not refuse, cancel, or mistreat a Seeker, and Seekers must not refuse or mistreat a Poster, on the basis of religion, caste, race, ethnicity, gender, sexual orientation, disability, language, marital status, or economic status. Discriminatory conduct, including discriminatory reviews or ratings, may result in loss of access to the Platform, and Pikando may exclude demonstrably discriminatory ratings from a user’s rating average.

    Users must report any safety incident, misconduct, harassment, or suspected illegal activity occurring during or in connection with a task as soon as possible, and in any event within 48 hours of the incident, through the in-app Report feature or to support@pikando.com. Timely reporting enables Pikando to preserve evidence (including chat logs and verification records) and act against the responsible user. Delayed reporting may limit Pikando’s ability to investigate or to consider the incident in dispute resolution.

    You must not solicit, hire, or engage a user you discovered through Pikando for tasks arranged outside the Platform, or encourage another user to transact off-platform. This applies to both Posters and Seekers. This restriction does not prevent Seekers from offering their services independently to customers they did not meet through Pikando.

    7.1 Off-Platform Transactions

    If users engage in off-platform transactions (payments, communications, or task arrangements outside Pikando), they do so entirely at their own risk. Pikando’s dispute resolution, payment protection, safety features, SOS system, and verification safeguards will not be available for any off-platform dealings. No refunds, insurance, or assistance will be provided. Users found facilitating or engaging in off-platform transactions may face immediate account suspension or termination.

    7.2 Protection of Minors

    Tasks involving interaction with minors (childcare, tutoring, babysitting, and similar categories) are subject to enhanced safeguards. Seekers must not have unsupervised access to minors unless explicitly disclosed and agreed upon in the task description. No exchange of minor personal data (photos, addresses, school details) is permitted outside the scope of the agreed task. Pikando reserves the right to report any suspected child safety concerns to relevant authorities, and users acknowledge and consent to this right.

    7.3 Automated Content Moderation and Matching

    Pikando uses automated systems, including AI-assisted tools, to moderate content, detect prohibited listings, identify potentially fraudulent activity, and enforce Community Guidelines. Automated decisions may include content removal, account warnings, or temporary restrictions. Users may request human review of any automated moderation decision by contacting support@pikando.com.

    Pikando uses algorithmic systems to rank, match, and display Seekers, tasks, and search results on the Platform. Ranking factors may include verification status, ratings, response time, proximity, availability, and other relevance signals. These systems are designed to optimise user experience and do not guarantee equal visibility or distribution of tasks among Seekers.

    8. Payments, Commission, and Taxes

    8.1 Payment Infrastructure

    All payments are processed through a Payment Aggregator licensed by the Reserve Bank of India. Funds paid by Posters are held securely by our payment partner until release conditions are met, in compliance with RBI Payment Aggregator Guidelines.

    8.2 Commission

    Pikando charges an 8% commission to the Poster on each completed task.

    The commission is calculated on the Agreed Price and is collected from the Poster at the time of payment, on top of the task value. Seekers currently pay 0% commission. Commission rates may be revised with prior notice. Changes apply only to tasks accepted after the effective date.

    Where referral credits or promotional discounts are redeemed by the Poster, the taxable value for commission purposes is the net amount after credits are applied.

    8.3 Settlement to Seekers

    When the Poster confirms completion (or auto-release occurs), Pikando releases the held funds immediately. Our payment partner then settles the released funds to the Seeker’s linked bank account on its standard settlement cycle. Pikando controls the timing of release; the time taken for funds to credit to the Seeker’s bank account is determined by the payment partner and the receiving bank, and is not controlled by Pikando.

    • Poster confirms completion: Funds released immediately on confirmation
    • Auto-release (no Poster response, no dispute): 48 hours after Seeker marks complete
    • Seeker bank credit (after release): Payment partner’s standard settlement cycle, approximately T+2 working days (excluding weekends and bank holidays); actual credit time may vary by bank
    • Dispute raised: Funds remain held until resolution (see Section 10)
    • Refund to Poster (where approved): Processed to the original payment method; see Section 10.5 for timelines by method

    8.4 Tax Obligations

    8.4.1 GST on Platform Commission

    Pikando is registered under the GST Act (GSTIN: 29AAPCP7341B1Z8). GST at 18% is charged on the platform commission under SAC Code 9985.

    8.4.2 GST on Household Services (Section 9(5))

    For services notified under Section 9(5) of the CGST Act (housekeeping, plumbing, electrical, cleaning, and similar household services), Pikando is the deemed supplier when the Seeker is an unregistered individual. In such cases, Pikando is liable for GST at 5% on the full task value, in addition to the 18% GST on commission. These are independent levies on different supplies. The applicable rate and classification for each task category is determined at the time of posting.

    8.4.3 TDS and TCS

    Pikando may deduct TDS at the applicable rate under the Income Tax Act, 2025 (or any statutory modification thereof) when a Seeker’s cumulative earnings exceed the prescribed threshold in a financial year. If the Seeker has not provided a valid PAN, a higher withholding rate may apply as prescribed by law. GST TCS at 0.5% under Section 52 of the CGST Act applies to transactions with GST-registered Seekers.

    8.4.4 Seeker Tax Responsibility

    Seekers are independently responsible for filing income tax returns, GST registration if annual turnover exceeds applicable thresholds (₹20 lakhs / ₹10 lakhs for special category states), professional tax, and any other tax obligations. Pikando provides settlement statements and earnings summaries to assist with compliance, but does not provide tax advice.

    8.5 Supported Payment Methods

    Posters may pay via UPI, debit cards (Visa, Mastercard, RuPay), credit cards (Visa, Mastercard, American Express, RuPay), net banking, and select digital wallets. Seeker payouts are processed via bank transfer (NEFT/IMPS/UPI) to verified bank accounts.

    8.6 Fraud Reserve and Withheld Settlements

    Pikando reserves the right to temporarily withhold, delay, or place a hold on Seeker payouts where there are reasonable grounds to suspect fraudulent activity, policy violations, or disputes that may result in refunds. Withheld funds will be released upon satisfactory completion of investigation, or adjusted in accordance with the dispute outcome.

    Where Pikando determines that a payout was obtained through fraud, misrepresentation, manipulation of the Platform, or violation of these Terms, Pikando reserves the right to reverse or recover such payouts by deducting from future settlements, seeking direct repayment, or pursuing legal remedies. The Seeker will be notified and given an opportunity to respond before any reversal is finalised.

    Pikando may restrict refunds, promotional benefits, credits, or platform access where patterns of abuse, fraudulent complaints, excessive cancellations, serial disputes, or bad-faith conduct are detected. Such restrictions may be applied automatically or following manual review.

    8.7 Referral and Promotional Credits

    Pikando may from time to time offer referral rewards, promotional credits, or discounts. Unless stated otherwise in the specific offer terms: credits have no cash value and cannot be withdrawn, transferred, or exchanged for cash; credits may carry an expiry date and lapse if unused; credits are limited to one account per individual and may be tied to device or payment-instrument identifiers to prevent abuse; Pikando may modify, suspend, or discontinue any referral or promotional program at any time; and Pikando may void or claw back credits obtained through fraud, fake accounts, self-referral, or other abuse. Use of credits may result in different effective prices for the same or similar services across users. Where credits are applied, commission and tax treatment follows Section 8.2.

    9. Cancellations

    9.1 Poster-Initiated Cancellations

    Once a Poster has selected a Seeker and payment is confirmed, cancellations are subject to the following schedule:

    • More than 2 hours before scheduled start: Full refund (100%)
    • Within 2 hours of scheduled start, or Poster no-show: Refund less a cancellation fee of up to 25% of the Agreed Price
    • After the Seeker has started work: Case-by-case through dispute resolution (Section 10), with proportional payment for work completed (using milestones if defined)

    Cancellation fees compensate Seekers for reserved time and preparation. The applicable fee and any Seeker compensation are determined by Pikando in accordance with this schedule and the dispute resolution process.

    9.2 Seeker-Initiated Cancellations

    Seekers are expected to honour task commitments. Cancellations are tracked and affect your standing and visibility on the Platform:

    • 24+ hours before start: No penalty, but the cancellation is recorded. Poster receives full refund.
    • Within 24 hours: Warning issued; repeat offences may result in temporary suspension.
    • No-show without notice: Serious penalty; may result in account suspension and negative review.
    • Emergency cancellations: Handled case-by-case with documentation required.
    • Repeated late cancellations (4 or more within a rolling 90-day period): Account review and possible suspension.

    10. Disputes and Refunds

    10.1 Raising a Dispute

    If an issue arises, we encourage Posters and Seekers to first attempt resolution through the in-app chat. If that fails, either party may raise a formal dispute through the app within the 48-hour window before auto-release. To raise a dispute: tap “Report Issue” on the task details screen and provide a description and, where requested, supporting evidence such as photos, screenshots, or chat logs. Pikando will acknowledge receipt within 24 hours.

    The dispute-raise window and the auto-release window are the same 48 hours: if no dispute is raised within 48 hours of the Seeker marking the task complete, the task auto-completes and the held funds are released to the Seeker. Separately, once a dispute is open, it is automatically escalated for senior review if it remains unresolved after 14 days.

    Pikando may also open a dispute on its own initiative, for example, where a task remains overdue with no completion recorded, or where a cancellation or mid-task exit request requires review. Both parties are notified when a dispute is opened, the task is paused, and funds remain held until the dispute is resolved.

    Once the Poster confirms completion or auto-release occurs, payment is final and Pikando’s internal dispute resolution process is no longer available for that task.

    10.2 Pikando Mediation

    Our resolution team will review task details, agreed terms, chat history, milestone completion status, and evidence from both parties. The team will communicate a decision within 15 days. Pikando acts as a neutral mediator. Decisions are based solely on evidence and policy.

    10.3 Resolution Outcomes

    • Full payment to Seeker: Task completed satisfactorily; Poster’s complaint lacks merit.
    • Full refund to Poster: Task not completed or significantly deficient; Seeker at fault. Commission is waived.
    • Proportional split: Both parties share responsibility, or work is partially completed. Commission is pro-rated on the amount paid to the Seeker. GST is adjusted proportionally on partial refunds.
    • Cancellation fee applied: Late cancellation by either party; fee deducted per Section 9.
    • No action: The complaint does not warrant any money movement; the dispute is closed and the task resumes its normal flow.
    • Task relisted: Where work has not meaningfully begun (for example, a Seeker no-show), the Poster may be refunded in full and the task reopened for new offers.

    10.4 Milestone-Based Proportional Splits

    Where a task includes milestones, the resolution team uses milestone completion status to determine proportional payment. Completed milestones are paid in full; the in-progress milestone is assessed based on evidence of work done.

    10.5 Refund Processing

    • UPI: 1-3 business days
    • Debit / Credit Card: 5-7 business days
    • Net Banking: 2-5 business days
    • Wallets: 1-3 business days

    Refunds are processed to the original payment method. If the original payment method is unavailable or the automatic reversal fails, Pikando will coordinate a refund to a verified bank account designated by the user. Platform credits may be offered as an alternative only with the user’s explicit consent.

    10.6 Commission on Refunds

    Full task cancellation before work begins: no commission. Full refund due to Seeker fault: no commission. Partial refund: commission pro-rated on the amount retained for the Seeker.

    10.7 Chargebacks

    Users agree to use Pikando’s dispute resolution process before initiating chargebacks through banks or card networks. Pikando will contest illegitimate chargebacks with documented evidence. Users who repeatedly initiate unjustified chargebacks may face account suspension.

    10.8 Further Recourse

    If you are unsatisfied with the outcome of the dispute resolution process, you may contact the Grievance Officer at nithyananda.kotian@pikando.com within 7 days, providing any new evidence. The Grievance Officer will acknowledge receipt within 24 hours and respond within 15 days.

    Where payment has already been released, the Grievance Officer may take non-monetary action such as account penalties against the other party, review or rating adjustments, goodwill credits at Pikando’s discretion, and documentation for pattern tracking. The Grievance Officer cannot reverse or claw back payments already released to either party.

    For monetary disputes after payment release, you may approach the Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, or pursue arbitration as set out in Section 16.

    10.9 Damage and Loss Claims

    If you believe a Seeker caused damage to or loss of your property during a task, you must report the claim through the in-app dispute/Report feature or to support@pikando.com within 48 hours of task completion, with supporting evidence (photographs, videos, and where applicable a police complaint for theft). Pikando will facilitate resolution between the parties as a neutral intermediary; any goodwill remediation by Pikando is made on a case-by-case basis, at Pikando’s sole discretion, without admitting liability and without creating any obligation in any other case, and is not insurance or an assumption of liability.

    Claims are assessed net of the following exclusions: pre-existing damage or wear-and-tear (Section 12.5); cash, jewellery, securities, and similar high-value portable items that were not secured as required by Section 6.2; sentimental or consequential value; items the Poster was required to secure before task commencement; and damage arising from conditions or hazards the Poster failed to disclose. Late-reported claims may be declined where the delay prevents fair investigation.

    11. Ratings and Reviews

    After task completion, both parties may rate and review each other. Reviews must be honest, fair, and focused on the service experience. You must not offer incentives for reviews, threaten negative reviews for leverage, create fake transactions to inflate ratings, retaliate after disputes, or include personal contact information in reviews.

    Persistently low ratings or repeated complaints may result in account review by our team.

    12. Platform Role and Limitation of Liability

    12.1 Intermediary Status

    Pikando is a marketplace platform, not a service provider. We do not employ Seekers, supervise the services performed, or guarantee outcomes. We claim intermediary protection under Section 79 of the Information Technology Act, 2000.

    12.2 Independent Contractor Status (Seekers)

    Seekers are independent contractors. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between any Seeker and Pikando. Seekers are free to: (a) maintain their own clientele and business outside Pikando without restriction; (b) offer and provide their services elsewhere, including through competing platforms; (c) accept or reject any task or Poster; and (d) set their own offer prices when bidding. Pikando does not supervise, direct, or control the manner, method, hours, or location of a Seeker's work. Seekers are not eligible for any employee benefits from Pikando, including but not limited to provident fund (PF), gratuity, paid leave, health insurance, ESI, minimum wages, or any other statutory or contractual employment benefit.

    Pikando does not guarantee that Seekers will receive any minimum number of tasks, earnings, or income through the Platform. Task availability depends on Poster demand, Seeker ratings, verification status, and other factors. No representation regarding potential earnings has been made by Pikando.

    12.3 Platform Provided “As Is”

    THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. PIKANDO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE PLATFORM’S AVAILABILITY, RELIABILITY, ACCURACY, SUITABILITY, OR UNINTERRUPTED OPERATION. Pikando does not warrant that the Platform will be free from errors, bugs, viruses, or interruptions, or that any defects will be corrected. This includes, without limitation, potential downtime of the app, payment processing delays, OTP delivery failures, verification system outages, and temporary unavailability of services in specific locations. Pikando does not guarantee that services or Seekers will be available at any particular time or in any particular location.

    Any time estimates, delivery timelines, or service durations provided on the Platform are indicative only and are not guaranteed. Actual timelines may vary due to task complexity, traffic, weather, access issues, or other factors beyond Pikando’s or the Seeker’s control.

    Marketing materials, promotional descriptions, and illustrative content on the Platform or in advertisements are for informational purposes only and do not constitute guarantees, warranties, or binding commitments regarding service quality, outcomes, or features.

    12.4 Assumption of Risk

    Users acknowledge that in-person services arranged through the Platform involve inherent risks, including but not limited to property damage, theft, personal injury, misconduct, exposure to unsafe environments, or disputes between users. By using the Platform for in-person tasks, you voluntarily assume these risks. Pikando is not liable for any loss, damage, or injury arising from interactions between users, whether or not the Seeker was verified through the Platform.

    12.5 Pre-Existing Damage and Wear

    Pikando and Seekers shall not be liable for pre-existing defects, wear-and-tear, structural weaknesses, or latent damage to property, appliances, fixtures, or belongings that existed prior to task commencement. Posters are encouraged to document the condition of relevant items or areas (photographs, video) before the task begins. In the event of a damage dispute, pre-existing conditions documented before the task will be considered during resolution.

    12.6 Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: Pikando makes no warranties regarding Seekers’ skills, qualifications, reliability, or suitability. Pikando shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Pikando’s total liability for any claim arising from these Terms or your use of the Platform shall not exceed the greater of the total fees paid by you to Pikando in the 3 months preceding the claim, or ₹10,000.

    Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

    12.7 Indemnification

    You agree to indemnify and hold harmless Pikando, its directors, officers, employees, and affiliates from any claims, damages, losses, and expenses arising from your use of the Platform, violation of these Terms, violation of any law, any dispute between you and another user, or any content you submit.

    12.8 Audit Rights

    Pikando reserves the right to audit, investigate, and review any user account, transaction, or activity where there are reasonable grounds to suspect fraud, policy violations, money laundering, or other illegal activity. Users agree to cooperate with such investigations, including providing requested documentation. Failure to cooperate may result in account suspension, withholding of funds, or termination.

    12.9 Law Enforcement Cooperation and Evidence Preservation

    Pikando may preserve, disclose, or share user information, chats, verification records, transaction logs, and uploaded evidence with law enforcement agencies where required by law, court order, or government directive, or where Pikando reasonably believes disclosure is necessary for the prevention, detection, or investigation of offences, protection of user safety, fraud prevention, or compliance with legal obligations.

    Pikando may preserve such records for dispute resolution, fraud prevention, legal compliance, or law enforcement purposes, even after account deactivation or task completion, in accordance with applicable data retention requirements.

    12.10 No Insurance Coverage

    Unless explicitly stated otherwise, Pikando does not provide insurance coverage for users, tasks, property damage, theft, personal injury, or losses arising from task performance. Users are strongly encouraged to maintain their own appropriate insurance coverage for tasks involving physical work, home visits, or handling of valuable property.

    12.11 Trust Score and Enforcement

    Pikando may consider user ratings, complaints, dispute history, cancellation patterns, fraud indicators, verification status, and policy violations when determining account visibility, task eligibility, or enforcement actions including warnings, restrictions, suspension, or termination. These assessments may be automated or manual.

    13. Data Protection and Privacy

    Your use of the Platform is subject to our Privacy Policy, which describes how we collect, use, store, and protect your personal data in compliance with the Digital Personal Data Protection Act, 2023 and other applicable laws. Key points:

    • Data is stored on servers located in India.
    • Your verification photograph is stored as your verification reference image and is used for subsequent identity checks. With your separate consent, it may also be set as your initial profile picture.
    • Arrival verification images are processed in real-time and deleted after matching.
    • Your Aadhaar number is not stored, only a tokenized verification reference.
    • You may exercise your rights as a Data Principal (access, correction, erasure, withdrawal of consent) by contacting privacy@pikando.com.

    By using the Platform, you consent to the collection and processing of your data as described in the Privacy Policy. Withdrawing consent for mandatory verification may affect your ability to use the Platform as a Seeker.

    14. Intellectual Property

    The Platform, including its design, features, content, trademarks, logos, and software, is owned by or licensed to Pikando. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purpose.

    You retain ownership of content you submit (task descriptions, images, reviews) but grant Pikando a worldwide, royalty-free, perpetual licence to use, display, reproduce, and modify such content for Platform operations and marketing.

    14.1 Intellectual Property Infringement

    If you believe that content on the Platform infringes your intellectual property rights, you may submit a complaint to support@pikando.com with a description of the copyrighted work, identification of the infringing material, your contact details, and a statement of good faith belief. Pikando will review and remove infringing content in accordance with the Information Technology Act, 2000 and IT (Intermediary Guidelines) Rules, 2021. Users who repeatedly upload infringing content may face account suspension or termination.

    15. Suspension and Termination

    15.1 By You

    You may request account deactivation by contacting support@pikando.com. Deactivation is processed after settlement of any pending transactions.

    15.2 By Pikando

    Pikando may suspend or terminate your account, without prior notice in severe cases, for breach of these Terms or Pikando Policies, fraudulent or illegal conduct, non-payment or payment fraud, providing false information, repeated complaints from other users, attempts to compromise Platform integrity, or requirements of law enforcement. Before termination (except in severe cases), Pikando will investigate and may request your explanation. Pending payments for tasks cancelled due to your termination will generally be refunded to the Poster, except where termination was due to fraud.

    15.3 Appeals

    You may appeal a suspension or termination by contacting the Grievance Officer within 15 days, providing any new evidence or clarification.

    16. Governing Law and Dispute Resolution

    16.1 Governing Law

    These Terms are governed by the laws of India, including the Indian Contract Act 1872, Information Technology Act 2000, Consumer Protection Act 2019, Consumer Protection (E-Commerce) Rules 2020, Digital Personal Data Protection Act 2023, Bharatiya Nyaya Sanhita 2023, and applicable RBI regulations.

    16.2 Disputes with Pikando

    For disputes between you and Pikando (as opposed to disputes between users), first contact our Grievance Officer at nithyananda.kotian@pikando.com. We will acknowledge within 24 hours and endeavour to resolve within 15 days. If unresolved within 30 days, either party may refer the matter to binding arbitration under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties (or, failing agreement within 15 days, appointed by the Bengaluru District Court). The seat and venue of arbitration shall be Bengaluru, Karnataka. Proceedings shall be conducted in English. The arbitrator’s award shall be final and binding on both parties, and enforceable in any court of competent jurisdiction. Each party shall bear its own costs unless the arbitrator directs otherwise.

    16.3 Jurisdiction

    Subject to the arbitration clause, courts in Bengaluru, Karnataka shall have exclusive jurisdiction.

    17. Miscellaneous

    • Electronic Acceptance: Your electronic acceptance of these Terms (by clicking “I Accept”, “Sign Up”, or similar) constitutes a valid, binding, and enforceable agreement under the Information Technology Act, 2000. Electronic records generated by the Platform are admissible as evidence under the Bharatiya Sakshya Adhiniyam, 2023.
    • Entire Agreement: These Terms, together with the Privacy Policy and Community Guidelines, constitute the entire agreement between you and Pikando regarding the Platform. Your use of third-party verification services (identity verification, background checks) is subject to those providers’ own terms, presented during those processes.
    • Class Action Waiver: To the fullest extent permitted by applicable law, you agree that any dispute with Pikando will be resolved on an individual basis only. You waive any right to participate in a class action, collective action, or representative proceeding against Pikando.
    • Survival: Sections relating to intellectual property, limitation of liability, indemnification, assumption of risk, dispute resolution, governing law, and any other provisions that by their nature should survive, shall survive termination or expiry of these Terms.
    • Account Inactivity: Pikando may deactivate accounts that have been inactive for a continuous period of 12 months or more, after providing 30 days’ notice to the registered contact. Any residual balance will be handled in accordance with applicable regulations.
    • Severability: If any provision is held invalid, the remaining provisions continue in full force.
    • No Waiver: Failure to enforce any provision does not constitute a waiver.
    • Assignment: You may not assign your rights without our written consent. Pikando may assign its rights to any successor entity.
    • Force Majeure: Pikando shall not be liable for failures caused by circumstances beyond reasonable control, including natural disasters, pandemics, government actions, or infrastructure failures.
    • Notices: Pikando may send notices electronically. Legal notices to Pikando should be sent to our registered office address.
    • Language: These Terms and other Pikando Policies may be made available in languages other than English for convenience. In the event of any inconsistency, the English version prevails.
    • Export Controls and Sanctions: The Platform is operated from India and intended for users in India. You represent that you are not subject to any sanctions administered by the Government of India, United Nations, or any other applicable sanctions authority, and that you will not use the Platform in violation of any applicable export control or sanctions laws.
